1. Acceptance of Terms

Winston the Pug ("the Service") is operated by us. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which forms part of these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Winston the Pug is a personal assistant accessible via messaging platforms including WhatsApp, Telegram and Signal, with Discord and Slack on the way. The Service connects to third-party platforms and services, including but not limited to Google Gmail, Google Calendar, Google Drive, and GitHub, to perform tasks on your behalf. Winston the Pug processes natural language requests and executes actions through authorised integrations with these services.

3. Fair Usage Policy

Usage of the Service is measured in tokens, which represent processing units consumed when generating responses and executing tasks. The following usage limits apply:

  • Solo plan: 2,000,000 (2M) tokens per day per user at $19.99/month.
  • Family plan: 2M tokens/day for the primary user ($24.99/month) plus 1,000,000 (1M) tokens/day added to a shared pool for each additional family member ($9.99/month each, up to 4 additional members).

Exceeding your daily token limit may result in throttled response times. The Service will not be suspended due to exceeding the fair usage limit. Token counts reset daily at midnight UTC.

4. Service Availability & Downtime

Winston the Pug is a managed service. We work to keep it available and responsive, and we carry out maintenance and updates on your behalf. We will communicate scheduled maintenance in advance via email and in-app notifications where practical. The Service is provided on an "as available" basis, without an uptime guarantee.

5. User Accounts

Each individual is limited to one account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Family plans allow multiple users to operate under a single subscription, with each family member maintaining their own individual profile and conversation history.

The primary account holder on a Family plan warrants that they are the parent or legal guardian of any child added to the plan, that they consent to the processing of their child's personal data as described in our Privacy Policy, and that they accept responsibility for their child's use of the Service.

6. Acceptable Use

You agree not to use the Service for any of the following:

  • Illegal activities or activities that violate applicable laws and regulations.
  • Harassment, abuse, or threatening behaviour directed at any individual or group.
  • Attempts to extract, reverse-engineer, or manipulate system prompts or internal configurations.
  • Abuse of the Service, including automated scripting intended to circumvent usage limits.
  • Transmitting malware, viruses, or other harmful code through the Service.

We reserve the right to suspend or terminate accounts that violate this acceptable use policy.

7. Third-Party Integrations

The Service integrates with third-party platforms including Google (Gmail, Calendar, Drive) and GitHub. These integrations are subject to their respective terms of service and privacy policies. Winston the Pug acts as an authorised intermediary, accessing these services on your behalf using OAuth tokens you explicitly grant. We do not assume liability for changes, outages, or policy modifications made by third-party service providers.

8. Intellectual Property

The Winston the Pug name, logo, branding, and all associated intellectual property are the exclusive property of Winston the Pug. You retain full ownership of all data, content, and materials you provide to or generate through the Service. We claim no ownership rights over your data.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of any material changes via email or in-app notification. Where changes affect processing activities based on your consent, we will request your renewed consent before applying those changes. If you do not agree with the changes, you may delete your account before they take effect and we will cease processing your data.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Nothing in these Terms affects your statutory rights as a consumer or your rights under applicable data protection law, including the UK GDPR and EU GDPR.
